Agreement to Terms

By accessing or using our website at www.drawviva.art, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

Account Registration and Eligibility

Registration: You must register for an account and provide accurate, up-to-date information. You are responsible for maintaining the confidentiality of your account information.
Eligibility: You must be at least 18 years of age or have the legal consent of a parent or guardian to use our services. By using our service, you represent and warrant that you meet all eligibility requirements.
Security: You are responsible for safeguarding your account credentials and must notify us immediately of any unauthorized use. You agree to not share your account with anyone else.

Service and Usage

Service Description: Drawviva provides an AI-powered image generation service that allows users to create images based on text prompts or other inputs.
Free Credits and Purchase Plans:
- •New users receive an initial 100 free credits to test the application.
- •Once your credits are exhausted, you may purchase additional credits in packs of 300, 700, or 2000.
Credit Consumption: Credits will be deducted based on the image quantity, quality, and size selected. Credits are non-transferable and generally non-refundable, except as provided in our Refund Policy.
Acceptable Use: You agree not to use the service for any unlawful or prohibited activity. You are solely responsible for complying with all applicable intellectual property laws regarding the images generated. Specifically, you agree not to:
- •Use the service to create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- •Infringe upon the intellectual property rights of others
- •Attempt to reverse engineer, decompile, or otherwise attempt to extract the source code of our service
- •Use the service to generate content that impersonates others or misrepresents your affiliation with any person or entity

Intellectual Property

User Content: Images generated using our service can be used for personal and commercial purposes. You are responsible for ensuring any generated content doesn't infringe upon third-party rights.
Service Content: All proprietary content, software, features, logos, designs, and materials on Drawviva are the exclusive property of Drawviva. Our service and content are protected by copyright, trademark, and other laws. You may not copy, modify, reproduce, or create derivative works of our service or content without express permission.
Feedback: If you provide us with feedback or suggestions regarding our service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without compensation to you.

Payment Terms

Purchases: All credit pack purchases are processed via our designated payment gateway, and payment is due at the time of purchase. By providing a payment method, you represent that you are authorized to use the method and authorize us to charge it for services you order.
Taxes: Prices for credits do not include applicable taxes; any tax liabilities are the responsibility of the user.
Pricing Changes: We reserve the right to change our pricing at any time. If we change pricing for an existing subscription, we will notify you in advance. Continued use of the service after a price change constitutes acceptance of the new price.
Refunds: Our refund policy is detailed separately in our Refund Policy document. Please refer to it for information about when refunds may be available.

User Representations

By using Drawviva, you represent and warrant that:

All information you provide is true, accurate, current, and complete
You will maintain the accuracy of such information
You have the legal capacity to agree to these Terms
You are not a minor in the jurisdiction in which you reside, or if you are a minor, you have received parental permission to use our service
You will not access the service through automated or non-human means (bots, scripts, etc.)
You will not use the service for any illegal or unauthorized purpose
Your use of the service will not violate any applicable law or regulation

Disclaimers and Limitation of Liability

Service Availability: While we strive to maintain uninterrupted service, we cannot guarantee continuous or error-free access. The service may be subject to limitations, delays, and other issues inherent in the use of the internet and electronic communications.
Warranty Disclaimer: The service is provided "as-is" without warranties of any kind, either expressed or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Limitation of Liability: Drawviva's liability is limited to the fullest extent permitted by law, and we shall not be liable for indirect, incidental, special, consequential or punitive damages, including lost profits, data, or goodwill, service interruption, computer damage or system failure or the cost of substitute services arising out of or in connection with these terms.

Indemnification

You agree to defend, indemnify, and hold harmless Drawviva and its subsidiaries, affiliates, officers, agents, licensors, and other partners from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the service or your breach of these Terms.

Termination

We reserve the right to suspend or terminate your account if you breach these Terms. Any unused credits may be forfeited upon termination. We also reserve the right to:

Change, suspend, or discontinue any aspect of the service at any time
Impose limits on certain features or restrict access to parts or all of the service without notice or liability
Delete any content or information you have posted on the service
Block users from certain jurisdictions from accessing the service

Even after your account is terminated, these Terms will remain in effect.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction where Drawviva operates, without regard to its conflict of law provisions. Any disputes will be resolved through binding arbitration or in the relevant courts, as determined by the applicable law. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Modifications

We may modify these Terms from time to time. The most current version will always be posted on our website. Your continued use of our services after any modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified terms, you should discontinue your use of the service.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy and any other legal notices and agreements published by Drawviva, constitute the entire agreement between you and Drawviva concerning your use of our services.
